Garmin & Fitbit Sued By Philips For Patent Infringement (Having To Do Mainly With The Apps).

by Anura Guruge

There seems to be four patents involved, and they, on face value, look pretty broad and vague, e.g., ‘providing performance data to an athlete‘! Another has to do with exercise functionality being monitored by a networked APP. Philips is claiming that Fitbit’s violations go back to 2007 (which is a long time) while Garmin only started to infringe 7-years later.

Philips is basically asking for damages and for Garmin & Fitbit to may a licensing fee going forward. This will drag through courts for years and each company will spend millions in lawyers’ fees arguing their case.

Deanna, quite rightly, is on the warpath about her Panasonic Lumix ZS19 and the sticking lens cover. Since we got this, the 3rd ZS20/ZS19, from Target — and Target is NOT Amazon — we can’t return it, as we would have been able with Amazon. This is why I buy most things from Amazon. Amazon rocks. Target sucks.

Since Deanna was beside herself, mad at heck with Target and Panasonic, I went looking for the Panasonic Web support site.

Panasonic Web & telephone support is a JOKE.

Ask Deanna. This is a shame. We like Panasonic. We have 3 Panasonic cameras and I just bought my 2nd Panasonic multi-handset telephone system.

Anyway we only have one option with this damn ZS19. We have to return it to bloody Panasonic and they will refurbish it. I am going to sell it or give it away after that. I am going to get a better camera.

Anyhow ….

Software updates for cameras! Wow.

Well, it makes sense. In 2007 when I got my Philips 47″ flat screen I HAD TO update the software, monthly, for the first year. Without the 1st update the damn thing didn’t even work. That is when I found out I had to update the software to get it to work.

Never even occurred to me that a digital camera would require updates. Well now I know.

It is good and bad. Yes, if you can fix or improve a product with a software update then it should be done. But, what I worry about, as with the Philips TV, is that now we will start getting half-developed products where you have NO OPTION but to keep on downloading software, month after month, until they get it to work.

The Skybox TV next to the DirecTV Genie. It is pretty small. The tall box directly below that is the DirecTV Wi-Fi ‘modem’ and next to that is my 2nd DVD/VCR player. On the shelf above is a Philips DVD player/Sound Bar. The 47″ Philips TV is above all of this.

It was GREAT! It made my day.

To be able to see all my West Indian and Indian ‘buddies’ in action again, FULL-SCREEN on my 47″ TV, in near HD quality, with none of the jerkiness associated with streaming video.

This was a delight. I was so happy.

The picture quality is sure better than what I was getting with DISH.

So it is indeed possible to get ‘TEN Cricket‘ on your TV independent of ESPN 3. That is real good news for us in the U.S.

I was using the Skybox TV device kindly provided to me by ZEE TV USA.

It is a little box that connects to your TV using HDMI and gets its content over the Internet using Wi-Fi. It is extremely easy to setup. Just two cables: power and HDMI. Then just type in your Wi-Fi network password. Bingo. Bob is your uncle. I am currently getting about 25 International channels — one of them TEN Cricket.

I can’t rhapsodize enough about the quality. I am always skeptical about video quality with streaming. The quality with SkyBox TV is beyond acceptable. As good, if not better, that what I got with DISH. No ghosting. No delay. No jitter. Just like broadcast TV.

I got to watch the 60 minute highlight package of the 2nd West Indies Tri-Nation Series played on June 30, 2013 between the West Indies and India. It was a good, tense match with some great hitting and some good wickets.

Johnson Charles played an innings of a lifetime. At the start he made Chris Gayle look pedestrian. His first 20 runs were all in boundaries. In the end he hit four sixes and eight fours. Though he perished, unnecessarily at 97, it was an innings of a lifetime. Reminded me of Collis Kings, unforgettable 86 (off 149) at the 1979 World Cup Final with Viv. I was THERE. I still remember the electricity of that innings and most of all Viv applauding Collis when he was finally out. Viv made a century but it was Collis’ that won the match. Johnson Charles’ innings was as worthy as that — and yes the West Indies won by 1 wicket with 2.2 overs to spare. Chris Gayle disappointed again. Of course I love Chris when he is firing on all cylinders, but as I have said before I have major doubts about his technique. And yet again in this match it was his technical ineptitude that let him down. That is why Dhoni has an average over 50 and Gayle has an average below 40. Ditto for Pollard and Samuels and possibly even Sammy. But it was a real fun match. So glad I got to watch it.

I will write more about this Skybox TV as I spend more time with it.

Right now, I am so happy to be able to watch TEN Cricket on my TV in the U.S.

Thank YOU ZEE TV USA.

They take chocolate very seriously, as they should, in Belgium.

Since I look like I am made out of dark chocolate I have always been ultra partial to all things chocolate. This is a hoot. Belgium actually is quite famous for its chocolate. All in all it is a fun place. I used to go to Brussels often on work; had a great gig doing 5 day training sessions for Philips sales folks. Just off the central square in Brussels they used to have a ‘Russian Tea Cafe’. They served brown ‘tea’ in Pyrex, see through mugs. There was only one thing that made this tea different — it was highly inflammable, and waiters would invariably hold a lighter to them and catch them on fire before they left you table. In reality it was all vodka with a perforated spoon with tea leaves dipped into it for color and a bit of flavor. So you were consuming vodka in the quantities that people drink tea. It was a riot. A few times I saw women being carried out, horizontally. They were totally stiff. Like cardboard cutoffs. Typically two men would carry them out like carrying a carpet. I guess that is what the vodka would do. Never bothered me. These training sessions were from 9 to 5 and I was on my feet for all but 75 minutes of that. But, I would party till 2 or 3 in the morning and still be fine for the next day. So, I am quite fond of Brussels and Belgium. Even thought about moving there at one point.

FitBit Ultra: So Sad … — Nov. 1, 2012.

I went looking for the HAPIfork and found this instead. Definitely looks like a FitBit alternative. I am sure Deanna, still FitBit’s biggest advocate, will check it out. Looks bigger. But, the ‘app’ looks cuter. They also appear to be pusing the motivational aspect. Yes, FitBit tries to do that, but it is not a key aspect. Yes, I know there are also other products, but I haven’t checked them out.

This gizmo isn’t shipping yet. I can’t even find a price. Given the publicity the HAPIfork is getting, this tracker will garner a following. I really haven’t looked at the HAPIfork in detail as yet. No, I do not plan to get one. Yes, it is well known that I eat fast, very fast. That is to be expected. ‘Type A‘ folks eat fast. A trademark trait. I am NOT a ‘Type A’. That has been well confirmed. I am a ‘Hyper Type A++++ … that reads the fine print on the toothpaste tube while brushing my teeth‘. I didn’t know this, but that ‘reading the toothpaste tube while brushing your teeth’ is what really separates the wheat from the chaff when it comes to Type A personalities. I was told this by a psychologist. It is not a bad trait. Just means that the brain craves stimulation. Plus, unless I am eating out, I very rarely eat without also doing something else. At night, I eat late. Invariably past 8pm. I usually watch TV while eating. Growing up I read while I ate. Actually my grandmother used to sit by my side and feed me so that I could concentrate on my reading. My father loves telling people about how old I was when this was still happening. Didn’t do me much harm. Got a lot of reading done. So, I doubt whether I will be slowing down my eating, HAPIfork or no HAPIfork.

The high-tech gizmo that we next need to get is this. Our second ‘ultrasound’ toothbrush, this time a high-end Philips, bit the dust just before Christmas. We had had it for about 2 years, and Deanna and I both used it. I detest the FAKE ‘ultrasound’ toothbrushes that dentist promote. They are not ‘ultrasound’. They just vibrate faster. This ‘Emmi-Dent‘, from what I can see, is the REAL McCoy. You don’t even brush with it! Plus you need special nano-technology toothpaste. That is cool. I will keep you posted on this toothbrush.
